Terms of Service

These Terms govern access to and use of 47Dynamics services. Contract-specific terms in signed agreements (including order forms and DPAs) prevail in case of conflict.

1. Provider

47Dynamics services are provided by SC TESTGATE SRL, RO47003208, Targoviste, Dambovita, Romania.

2. Service Scope

The platform provides multi-tenant IT management capabilities including monitoring, automation, security, remote operations, and commercial operations according to purchased plan and contractual terms.

3. Access and Security

• Customers are responsible for safeguarding credentials and privileged account access.
• Use of the service must comply with applicable law and acceptable-use restrictions.
• Abusive, unauthorized, or unlawful use may lead to suspension.

4. Data Processing

Processing of personal data is governed by applicable data processing terms and the Privacy Policy. Customers remain responsible for legal basis and instructions for their own tenant data.

5. Availability and Support

Service levels and support commitments are defined contractually. Planned maintenance and emergency interventions may occur for security and reliability reasons.

6. Fees and Payment

Fees, billing cycles, and payment obligations are defined in commercial agreements and invoices. Late payments may trigger remedies stated in contract and applicable law.

7. Intellectual Property

All rights in the platform remain with SC TESTGATE SRL and licensors. Customers retain rights in their own data.

8. Liability and Warranty

The service is provided under commercially reasonable standards and contractual warranties. Liability limitations and exclusions are determined by signed agreements and mandatory law.

9. Governing Law

Governing law and dispute venue are set by contract. In the absence of specific provisions, Romanian law may apply where legally required.
